Psychology Board Investigates Dr. Phil

TMZ has obtained a copy of a complaint against Dr. Phil which was lodged with the California Board of Psychology, alleging the TV doc was illegally practicing without a license when he paid a visit to one Britney Spears.

We've learned the person who filed the complaint is a psychologist. Dr. Phil has never been licensed to practice in California, and he retired his Texas license in 2006.

The shrink believes when Dr. Phil visited Brit in the hospital earlier this month, he was practicing psychology. A "Dr. Phil" honcho told TMZ the visit was never meant to lure Britney onto the TV show -- and that there were never plans to put her on the air.

A Psychology Board rep told TMZ if the Board finds the complaint credible, it would be referred to the D.A. for review. Practicing without a license is a felony in California.

The psychologist who filed the complaint also alleges Dr. Phil violated HIPAA laws by "discussing or divulging a patient's medical condition ... with the media," in reference to a press release issued by Dr. Phil.

The complaint also says, "A petition is being circulated to remove the "Dr. Phil" show from the air." We're told the shrink is trying to get other psychologists to sign.

As for the Dr. Phil show's response -- no immediate comment.

391. Leave Dr. Phil alone 1st Stern you are mad because he is a better person that took your viewers away. Anyway seeing Britney can see is in need of help. The girl is a spoiled brat that is sick in the head anyone can make the same conclusions Dr. Phil observed. She is a mother act like one and stop acting a spoiled brat for attention for attention. She does not deserve her kids and they do not need to be brought out in such situations she is acting on. Many people can say the same thing Dr. Phil said in just watching her spoiled ways. 393. I never realized Phil's credentials were in question; however, his behavior was always questionable from any professional's point of view. Pure sensationalizism has, unfortunatelely corrupted many people and not the least this man. Although, I don't think this was new for him. Too many are so impressed with people who just speak their minds. For example, Dr. Laura, all the talk show genres of straight talk and Dolly Parton in "Straight Talk" (which was delightful). His self righteous advice and self promotion from a very limited viewing perpective has always been a concern for me. WHY in the WORLD did OPRAH endorse him?!

394. Brittany is a danger to herself and others! Why do you think her kids were taken away? She can be committed against her will. In florida it used to be called the Baker ACT. I had my mom committed. She was an alcoholic. Brittany's family can have her committed and they should.

395. Okay...I know there's a lot of people who don't like Dr. P....and that's okay. But, let's not forget all the good he has done. Not 'he' personally, but there's probably a lot of people in the country who have benefited from some aspect of the 'advice' offered on his show. No, I can't cite personal knowledge of any particular incidents, but I do know television can expose thousands of people to ideas. If his show has saved one life.. it was worth it. So, personally, I don't have to like the show. I was surprised to see him on ET.....and yes, we live in a country where we have the RIGHT to speak our opinions, and that's great... but at the same time, I'm not impressed by all the people who post on here....doing nothing but bashing Dr. P for doing what he does. Get over it and get real.

397. It is about time that the bag of wind got it. He and his wife have been giving out alot of bad info for years. He has to go.
He is a self proclaimed expert. His wife has no degrees and she also is a self proclaimed expert..
Get them off the air and back to the FARM.

398. VERY disappointed in "dr" Phil. If I had known he was not licensed in the State of California while doing his show, I never would have started watching him. Sounds like he got a bit too big for those Texas britches. What goes around comes around, especially if you got rich being referred by Oprah!!! Is that awful Dr. Oz next?? Hope so. Leefuzz

399. Give Dr.Phil a break. He tried to help her. His only mistake, was he should of helped the mother. I was on the Dr. Phil show. It was only a fun show about phobias. Mine was not serious. I will say this though. After the show is over and the weeks following, he follows up on you and takes care of what you may need. He does not have to do that. He does get people on for ratings, so does Oprah...but he stays with them and follows up. What about Oprah promising those girls they will be protected? Then they are abused? I know she did not want that to happen but it did. Has anyone wanted to attack her for that? And who the hell would listen to a thing that comes out of that pervert Howard Sterns mouth anyway??? What did Dr. Phil say, that Britney has not shown and more????

400. I believe Dr.Phil makes good sense, He has helped many. He came from poor background himself and now is using his knowledge to help ohers. We need more folks like him with the society we have. I Guess if any Dr.see a auto accident and help the victim he can be sued today, what a shame.. Anyone that has $$$$$$$$ is a target. The girls family could have made a move to help Britany and should have, but now they see money, and SUES. but as of this date, they have not commited Brittany. Don't they at least care enuff about 2 little children to help , so they have a normal functional Mother for their care ? Dr. Phil said no more then any other news media about Brittany condition for example Fox, ShowBiz tonite,Nancy Grace.. the list can go on & on..

402. I don't believe Dr. Phil has ever had a genuine concern for any guest since I've been watching for 4 years. I've always been surprised how his "producers" obtain information and quotes from his guests prior to the show, and the guests, on numerous occasions, swear that the information was promised not to be devulged publicly. Naturally the producers deny it. Every counselor knows that people lie or omit to favor their own point of view. It sickens me to watch his inept bias toward and or against a guest at the very beginning of his show based on pre show grilling by his producers, and the studio audience applauds like trained seals. In the case of Britney Spears, it's obvious that Dr. Phil was attempting to line his pockets not help Britney.

GOOD! they should of investiagated him long ago, when he was so kind to Howard K Stern's family & NOT Anna's... what a disgrace of a doctor.. now brittney? he sure didnt care WHY howard K Stern sat back & did NOTHING when Anna was taking drugs while she was PREGNANT with DANNIELYNN!!! OR did he ask that question?He makes me want to throw the remote at the tv, & thats why I DONT WATCH CBS!! EVER AGAIN!!!

404. 363. I enjoy watching the Dr. Phil Show. Anyone with half a brain knows it is all just for entertainment. I don't always agree with him, but that's part of life. If you don't like the show, don't watch it. As far as Dr. Phil going to see Brittney Spears. He was asked by the family to go. Probably because for whatever reason, they couldn't check on her themselves. They are friends and they asked him to "size up" the situation for them. The media always blows things out of proportion. Don't you know that?

Well duh probably because she did not want them to visit. There is such a thing such as a patient's privacy. If I do not want my parents or any one else to visit me in the hospital then they can not just barge in. That goes for the Quack Dr Phil. He was let in without approval from Britney AND he was not her doctor nor had he ever been.

Therefore he and the hospital broke laws right there.

No one is talking about the show they are talking about how he barged in and trampled on a patient's right to privacy then ran like the quack he is to make a press confrence about Britney Spears.

I hope she sues him and the hospital and hopefully then people will realize that a patient has a right to their privacy especially from vultures like Dr. Phil.
